2. INFORMATION AND CONSENT
The General Data Protection Regulation (Regulation (EU) 2016/679 of the Parliament and of the Council of April 27, 2016, hereinafter “GDPR”) and Law no. 58/2019 of August 8, which ensures the implementation of the GDPR in the Portuguese legal system, establish the legal rules on the protection of natural persons with regard to the processing of personal data and the free movement of such data.
“Personal data” means any information of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person, and protection does not cover the data of legal persons.
This Privacy Policy sets out how GREENFLOW uses the personal data of its customers and potential customers (hereinafter the user), and these terms apply to and are accepted by them from the moment the user gives their consent as part of their contact registration via the website https://www.greenflow.pt/.
The site may contain hyperlinks to other commercial partner sites. If the data subject uses a link, please note that these partners have their own privacy policies, for which GREENFLOW has no responsibility or liability.
Currently, no session cookies are used when accessing, browsing and using the site.
When registering to contact the site, the user provides data relating to:

  • Name;
  • Email address;
  • Telephone contact;
  • Name of the company represented (optional), and through the tick / option to “Confirm the acceptance message RGDP” field, you are declaring your knowledge and assent to the terms of the privacy policy contained herein, as well as the informed, express, free and unequivocal consent for the data provided to be included in a file under the responsibility of GREENFLOW, whose processing under the terms of the legal regulations complies with the appropriate technical and organizational security measures.

When collecting personal data, except in fields where otherwise indicated, the user may voluntarily provide personal data, without the lack of response implying a decrease in the quality or quantity of the corresponding services (unless otherwise indicated). However, failure to respond to data that is considered mandatory will result in the user being unable to access the service for which the data was requested.
GREENFLOW will only maintain a database with the registration of its customers. The data contained in this database is solely the data provided by the customer at the time of registration and is collected and processed automatically under the terms approved by GREENFLOW, the entity responsible for the corresponding file. The data is sent directly by email and is not stored/registered on the website. Under no circumstances will information be requested about philosophical or political beliefs, party or trade union membership, religious faith, private life and racial or ethnic origin, as well as data relating to health and sex life, including genetic data.
Under no circumstances will any of the following activities be carried out with the personal data provided to us through this website:

  • Sharing with other persons or entities without the prior consent of the data subject;
  • Transfer outside the European Economic Area (EEA) without the prior consent of the data subject.

3. PURPOSES OF THE PROCESSING OF PERSONAL DATA

Although GREENFLOW collects data through its website in a secure manner, which prevents it from being lost or manipulated, using the most advanced techniques for this purpose, we would like to inform you that collection on an open network allows personal data to circulate without security conditions, running the risk of it being seen and used by unauthorized third parties.
The processing of the personal data collected does not involve automated individual decisions.

4. ACCESS, STORAGE AND SHARING OF PERSONAL DATA
Access to data is exclusive to GREENFLOW employees duly authorized for this purpose and strictly for purposes related to the service to be provided or to comply with legal requirements.
The data provided is kept for the time deemed necessary for the provision of the service requested by the client or used within the scope of the contact record, and, as a result of this processing and the development of the commercial relationship, for the time required by law or until such time as its deletion is requested.
In order to fulfill the purpose of this website, GREENFLOW may share your personal data with other entities, which will process it exclusively for contact management and processing activities.
The entities to which GREENFLOW may share your data under the above terms are subcontracted entities for the provision of contact management and processing services, which are obliged to adopt the necessary technical organizational measures to protect the data shared under the terms established contractually with GREENFLOW.

GREENFLOW declares that it has implemented and will continue to implement the security measures of a technical and organizational nature necessary to guarantee the confidentiality and security of the personal data provided on the website in order to prevent its alteration, loss, processing and/or unauthorized access, taking into account the current state of technology, the nature of the data stored and the risks to which they are exposed.
Data is collected and processed in a secure manner that prevents its loss or manipulation. Users can check that their browser is secure if the padlock symbol appears or if the address begins with https instead of http.
Personal data is treated with the level of protection legally required to guarantee its security and prevent its alteration, loss, processing or unauthorized access, taking into account the state of the technology, the user being aware and accepting that Internet security measures are not impregnable.
GREENFLOW, whenever it accesses any personal data, undertakes to:

  • To store them by means of legally required security measures of a technical and organizational nature, which guarantee their security, thus preventing alteration, loss, unauthorized processing or access, in accordance with the state of the technology at any given time, the nature of the data and the possible risks to which they are exposed;
  • Use the data exclusively for the purposes previously defined;
  • Ensure that the data is only processed by employees whose intervention is necessary for the provision of the service, who are bound by the duty of secrecy and confidentiality. If the information may be disclosed to third parties, they must be obliged to keep it confidential in accordance with the provisions of this document.

One of the purposes for which we process personal data provided by the user is to send electronic correspondence with information on commercial and promotional communications.
Whenever we make a communication of this type, it will be directed exclusively to the user who has expressly authorized it in advance.

7. EXERCISE OF RIGHTS
In accordance with the law, users may exercise their rights of access, rectification, erasure, restriction, objection and portability at any time by sending a request to the following e-mail address: info@greenflow.pt.
These rights are not absolute and must be weighed against GREENFLOW’s legal, regulatory, administrative and judicial obligations, as well as against its legitimate rights and interests.
With regard to the rights of limitation, opposition and erasure, their exercise may be subject, in accordance with the legislative measure established under Article 23 (1) and (2) of the GDPR, to justified and proportional limitations in consideration of the pursuit of the public interest pursued by GREENFLOW in the specific case. Requests from data subjects will be processed within the legally established limits and, as a rule, all requests will be answered within a maximum of one month.

 

8. CONTROL AUTHORITY
Under the terms of the legal regulations, the data subject has the right to lodge a complaint regarding the protection of personal data with the competent supervisory authority, the Comissão Nacional de Proteção de Dados (CNPD), at: https://www.cnpd.pt/.

GREENFLOW ensures that the information processed is correct and up to date, as well as guaranteeing the adoption of appropriate measures so that data subjects can exercise their rights in accordance with the law.
